Appellate Strategy

When a case goes on appeal, I work with a client (or its trial counsel) to develop and implement a cost-effective appellate strategy. This includes selecting and framing legal issues, fine-tuning legal arguments, soliciting amicus support, and evaluating the chances for success.

Brief-Writing

Drafting concise, well-researched, persuasive legal briefs is the most important part of appellate practice. I have more than five decades of experience doing exactly that.

Oral Argument

The best oral arguments are conversational, not rhetorical.  When an appellate court schedules a hearing, I study the record, reduce legal arguments to the most important points, and try to anticipate the questions that I will be asked. This type of preparation helps make my oral presentation seem as unrehearsed as possible.

Amicus Briefs

I have extensive experience drafting amicus curiae briefs for industry trade associations, and for nonprofit advocacy organizations such as the Atlantic Legal Foundation. These friend-of-the-court briefs give my clients a direct voice in the  Supreme Court, federal courts of appeals, and state appellate courts on legal issues that are important to them and to their members and supporters.
