Larry Ebner is an accomplished, independent, pro-business, appellate litigation specialist with more than a half-century of professional experience. He represents companies of all sizes, industry trade associations, and nonprofit public interest groups in the Supreme Court, federal courts of appeals, and state appellate courts.
At his nationwide appellate litigation boutique, Capital Appellate Advocacy PLLC, Larry handles appeals that involve cutting-edge federal legal issues, authors amicus curiae (“friend of the court”) briefs in key cases, and advises trial counsel on appellate strategy and procedures. Instead of billing by the hour, Larry charges flat fees for his appellate services.
At the Atlantic Legal Foundation, a national, nonprofit, public interest law firm, Larry is Executive Vice President & General Counsel. He conducts ALF’s renowned amicus curiae program, and has personally authored dozens of its amicus briefs, primarily in the Supreme Court and federal courts of appeals. ALF’s briefs advocate for individual liberty, free enterprise, property rights, limited and responsible government, sound science in judicial and regulatory proceedings, and effective education, including parental rights and school choice.
Larry has been elected as a Fellow of the highly selective American Academy of Appellate Lawyers, and is a graduate of Dartmouth College and Harvard Law School.
Larry’s volunteer professional activities include serving the peer-vetted Federation of Defense & Corporate Counsel as Chair of its Appellate Law Section and as a Vice Chair of its Amicus & Public Policy Committee. During 2023 & 2024 Larry was Chair of the DRI Center for Law and Public Policy, and continues to serve on The Center’s Management Council as Advisory Council Liasison. Larry also is a past Chair and a longtime member of DRI’s Amicus Committee, and a former Director of the National Foundation for Judicial Excellence. He also is President of the Washington, D.C. Chapter, and a Board of Directors member, of the International Network of Boutique and Indpendent Law Firms.
Larry is a prolific author of legal articles and blogs, and a sought-after speaker, on a broad variety of federal law and appellate practice topics important to his professional colleagues throughout the United States.
In August 2024 DRI awarded Larry its Tom Segalla Excellence In Education Award. The award is given to a “member of DRI whose contributions through legal scholarship exemplify the highest educational standards of the organization and further its mission of improving the skills of the defense practitioner.”
Thomson Reuters has repeatedly selected Larr as one of only several solo-practitioner, Washington, D.C.-based, Appellate “Super Lawyers.” Law360 has twice appointed him to its Appellate Editorial Advisory Board.
Larry began his legal career in 1972 as an Honors Program attorney in the Civil Division of the U.S. Department of Justice. Two years later he joined a now-global law firm, where he founded and led the appellate practice group. He launched his own appellate boutique law firm, Capital Appellate Advocacy, in 2016.
Barbara and Larry Ebner have been married for 52 years and enjoy spending time with their two daughters, sons-in-law, and six grandchildren.
